Newsletter service terms and conditions

§ 1. General provisions

  1. These Terms and Conditions (hereinafter: the “Terms”) define the rules for the provision of the Newsletter service by e‑Place Tomasz Budzyński, based in Rzeszów (35-203), Siemieńskiego 17a/5, NIP: 5170364287, REGON: 181042943 (hereinafter: the “Service Provider” or “Controller”).
  2. The Newsletter service consists of periodically sending commercial, marketing, educational and informational content regarding the Controller’s activities, products, services, promotions, and events to the email address provided by the User (hereinafter: the “Newsletter”).
  3. Using the Newsletter service is voluntary, free of charge, and requires an active email account and internet access.
  4. The terms used in these Terms shall mean:
    a) “User” – a natural or legal person who has subscribed to the Newsletter;
    b) “Double opt-in” – a confirmation mechanism consisting of clicking an activation link sent to the User’s email address.

§ 2. Newsletter subscription

  1. Subscription is done by providing an email address in the form on the Controller’s website and giving consent to:
    a) the processing of personal data for the purpose of providing the Newsletter service in accordance with the Terms and the Privacy Policy;
    b) receiving commercial communications by electronic means under the Polish Act of 18 July 2002 on the provision of electronic services.
  2. Consent is given by ticking the appropriate checkboxes in the form (opt-in mechanism).
  3. After submitting the form, the User will receive an email with an activation link (double opt-in mechanism). Clicking the link completes the registration process. Failure to confirm within 24 hours will invalidate the subscription request.

§ 3. Personal data protection (GDPR)

  1. The controller of Users' personal data is e‑Place Tomasz Budzyński, based in Rzeszów (35-203), Siemieńskiego Street 17a/5. Contact: [email protected]
  2. Personal data (email address and name) are processed for the purpose of providing the Newsletter service based on the User’s consent (Art. 6(1)(a) GDPR).
  3. Personal data will be stored until the User withdraws consent, and thereafter for the period necessary to establish, exercise, or defend claims.
  4. The User has the right to:
    a) access their data;
    b) rectify their data;
    c) delete their data (“right to be forgotten”);
    d) restrict data processing;
    e) data portability;
    f) object to processing;
    g) withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal);
    h) lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).
  5. To exercise these rights, the User may contact the Controller or use the unsubscribe link included in each Newsletter message.
  6. Personal data may be transferred to entities processing data under data processing agreements that ensure protection in accordance with GDPR.
  7. Personal data are not transferred outside the European Economic Area.
  8. Providing data is voluntary but necessary to use the service.

§ 4. Unsubscribing from the Newsletter (Withdrawal of Consent)

  1. The User may unsubscribe from the Newsletter at any time without giving a reason.
  2. Unsubscribing is done by clicking the unsubscribe link in the footer of any Newsletter email or by sending a request to the Controller’s email address.
  3. After unsubscribing, the User’s email address will be promptly removed from the subscriber database, subject to §3 point 3 regarding data retention.

§ 5. Complaints

  1. Complaints regarding the Newsletter service may be submitted via email to: [email protected]
  2. The complaint should include the User’s email address and a description of the issue.
  3. The Controller will consider the complaint within 14 days of receipt and inform the User of the outcome via the email address provided.

§ 6. Final Provisions

  1. The Controller reserves the right to amend these Terms for valid reasons (e.g. changes in legislation, service functionality).
  2. The Controller will notify Users of changes to the Terms by email or via an announcement on the website at least 14 days before the changes take effect.
  3. If the User does not accept the new conditions, they may cancel their subscription in accordance with §4.
  4. For matters not covered herein, the provisions of the Civil Code, the Act on the provision of electronic services, and Regulation (EU) 2016/679 (GDPR) shall apply.

These Terms enter into force on: 23 April 2025
